Terms of Use

These Terms of Use ("Terms") form a binding legal agreement between you ("you", "User") and Fresh Glob ("Fresh Glob", "we", "us", "our"). By creating an account, accessing, browsing, or using any part of the Fresh Glob website, application, APIs, charts, scanners, signals, bot engine, paper-trading book, or any related service (collectively, the "Service"), you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy and Risk Disclaimer. If you do not agree, you must not use the Service.

You must be at least 18 years old (or the age of legal majority in your jurisdiction) and legally capable of entering into a binding contract. You represent that your use of the Service does not violate any law, regulation, or contractual obligation that applies to you.

Fresh Glob is a software analytics and information product. Fresh Glob is NOT:

• a broker, broker-dealer, dealer, introducing broker, or futures commission merchant;
• an investment adviser, financial adviser, financial planner, or fiduciary;
• a commodity trading adviser (CTA), commodity pool operator (CPO), or hedge fund;
• a securities exchange, alternative trading system, or clearing house;
• a bank, money transmitter, or custodian of any kind.

We do not hold customer funds, do not execute trades on your behalf, and do not provide personalized investment, tax, accounting, or legal advice. Nothing on the Service is a recommendation, solicitation, offer, or endorsement to buy, sell, or hold any security, derivative, commodity, currency, digital asset, or other instrument. All content — including scanner results, signals, charts, watchlists, bot output, indicators, news summaries, sentiment data, and any AI-generated text — is provided for general informational and educational purposes only. You alone are responsible for every trading and investment decision you make, and you should consult a licensed professional before acting.

The "FreshGlob Paper" book is a simulated environment. Simulated results have inherent limitations: they are hypothetical, do not represent actual trading, and may not reflect slippage, liquidity, fees, taxes, latency, or market impact. Past simulated performance is not indicative of future actual or simulated results.

If you enable the Bot Engine, you acknowledge that automated strategies can lose money rapidly, including more than your initial allocation, and that bugs, network failures, data outages, exchange outages, mis-configurations, or unexpected market conditions can cause unintended trades or losses. You are solely responsible for the configuration, monitoring, and consequences of any bot you create, deploy, pause, or run. You agree to the separate Bot Risk Acknowledgment shown when you start the engine.

Market data, news, broker connections, payment processing, and other third-party content are provided "as is" by their respective providers. Fresh Glob does not warrant the accuracy, timeliness, completeness, or availability of third-party data and is not liable for any errors, delays, outages, or losses arising from it.

Paid features are billed in advance on a recurring basis through our payment processor. Except where required by law, all fees are non-refundable. You may cancel at any time; cancellation takes effect at the end of the current billing period.

You agree not to: (a) reverse engineer, scrape, or resell the Service; (b) use the Service to violate any law or third-party right; (c) attempt to gain unauthorized access to any system or account; (d) misuse APIs or exceed rate limits; (e) upload malicious code; or (f) misrepresent your affiliation with any person or entity.

The Service, including all software, content, trademarks, and design, is owned by Fresh Glob or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes, subject to these Terms.

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted operation. Fresh Glob does not warrant that the Service will be error-free, secure, or continuously available, or that any signal, indicator, or output will be profitable.

To the maximum extent permitted by law, Fresh Glob, its affiliates, officers, employees, agents, partners, and licensors shall NOT be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, trading losses, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Service — even if advised of the possibility of such damages. In all cases, Fresh Glob's aggregate liability to you for any claim shall not exceed the greater of (a) the amount you paid Fresh Glob in the 3 months preceding the claim, or (b) US$100.

You agree to defend, indemnify, and hold harmless Fresh Glob and its affiliates from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) any trade or investment decision you make; (c) your bots, strategies, or configurations; (d) your violation of these Terms; or (e) your violation of any law or third-party right.

Trading and investing in securities, options, futures, forex, and digital assets involve substantial risk of loss and are not suitable for every investor. You may lose some or all of your capital. By using the Service you knowingly and voluntarily assume all such risks and waive, release, and discharge Fresh Glob from any and all claims, demands, or causes of action arising from your trading, investment, or financial decisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively by final and binding individual arbitration, and not in court, except that either party may bring an individual claim in small-claims court. YOU AND FRESH GLOB EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Subject to Section 14, the state and federal courts located in Delaware have exclusive jurisdiction over any non-arbitrable dispute.

We may modify these Terms at any time by posting an updated version. Continued use of the Service after changes constitutes acceptance. We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms.
